Early contractor involvement for remedial projects

Early contractor involvement (ECI) brings construction input into a remedial project while the design, access strategy and procurement approach can still be shaped. For an owners corporation or asset owner, the useful question is whether contractor input now will resolve decisions that would otherwise remain uncertain at tender.

Engage early when access, occupied areas, concealed defects or the construction sequence could materially change the scope. Where the design and delivery requirements are already well defined, a properly prepared tender may be the more direct next step.

When is early contractor involvement useful?

A preconstruction appointment should answer specific questions. These are common decision points on remedial buildings:

Access could determine the repair method
Scaffolding, elevated work platforms and other access systems have different site, design and operating requirements. Early review can identify how access affects work zones, adjoining properties, public protection and the construction programme.
The building must remain in use
Apartment access, business operations, deliveries, emergency routes and temporary weather protection need a workable sequence. Contractor input helps the design team test whether the proposed work can be delivered under those constraints.
Important conditions remain concealed
Opening-up, investigation and trial work may be needed before quantities or details can be finalised. Define the investigation scope and permissions separately, with the appropriate technical team, rather than treating an early budget as a fixed construction price.
Several repair systems meet at the same location
Windows, cladding, waterproofing, concrete repairs and roof edges can affect one another. Reviewing interfaces before tender helps identify which package supplies each detail, protection measure and reinstatement task.
Procurement decisions affect the design
Product availability, fabrication information, samples and specialist input may influence the programme. Discuss these early enough for the project team to consider suitable options before commitments are made.

ECI adds less value when it simply repeats a completed design review without resolving a live decision. Start with the questions, the evidence available and the outputs needed to move the project forward.

What should the preconstruction appointment deliver?

Agree a short, measurable brief for the early phase. Depending on the project, SCE can provide construction planning and contribute its engineering, design, procurement and delivery expertise through its team and appropriately appointed specialists.

  • Constructability review: practical comments on the proposed repair approach, access, temporary works requirements, interfaces and sequence, with design decisions referred to the responsible designer.
  • Options comparison: alternatives assessed against scope, performance requirements, disruption, programme and cost assumptions. An alternative must meet the project’s required performance.
  • Outline staging and procurement plan: work areas, resident or operational constraints, key submissions, likely lead-time dependencies and decisions that control the start date.
  • Scope and risk schedule: known conditions, unresolved investigations, exclusions, provisional quantities and responsibility for obtaining missing information.
  • Budget advice with an explicit basis: the documents, quantities, rates, allowances and assumptions behind the estimate, and the items needed before firmer pricing is possible.
  • A decision record: options accepted or rejected, reasons, outstanding actions, responsible parties and the agreed next procurement stage.

For example, a façade scope might be technically described but still lack an agreed access arrangement. A useful early appointment would compare feasible access approaches and their consequences, identify required specialist design and approvals, and recommend what the tender documents need to include. A generic assurance that access will be “managed on site” would not resolve that issue.

Set the commercial and professional boundaries first

Confirm the early-stage services, deliverables, fees, information the client will provide, programme and review points in the appointment. Agree how the resulting information can be used in the next stage and what happens if the parties do not proceed to a construction contract. Obtain appropriate contract advice for those terms.

ECI does not automatically transfer design responsibility or appoint a statutory certifier. Where SCE is engaged for design-and-construct or full engineering, procurement and construction delivery, the agreed responsibilities still need to identify the qualified and appropriately registered or licensed parties carrying out each function.

How does ECI lead into tender or construction?

The early phase should end at a defined decision point. The owner and project team review the outputs, close critical information gaps and choose the appropriate route forward. That may involve a competitive tender, further design development or negotiation of a separately agreed construction contract.

  1. Confirm what has been resolved. Record the accepted scope, options, assumptions and design status.

  4. Complete the construction handover. Once the delivery arrangements are agreed, use a controlled consultant-to-contractor handover to establish the issued information and responsibilities.

An ECI appointment does not, by itself, guarantee the main contract, a fixed final price or a particular saving. Its value depends on the decisions it resolves and the quality of the information carried into delivery.

What to provide for an early discussion

Send the building location and use, available reports or drawings, photographs, known defects, access constraints, occupancy requirements, target programme and the decisions you need to make. Is early contractor involvement the same as design and construct?

No. ECI describes an early phase of contractor input. The eventual construction contract and design responsibilities are separately agreed and may use a design-and-construct, construct-only or another suitable arrangement.

Does an ECI appointment guarantee the main construction contract?

No. The appointment should state how the project can progress and what happens if it does not. Early participation alone does not guarantee appointment for the construction stage.

Can an early estimate be treated as a fixed construction price?

Only where the agreed scope and pricing terms support that commitment. Early estimates should identify their document basis, allowances, exclusions and unresolved conditions. Further investigation or design may be needed before firmer pricing.
